These Terms of Use (“Terms”) govern your access to and use of the website operated by Nexgen Projects UAE at nexgenprojectsuae.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

The Site is intended for use by professional principals, advisors and corporate representatives. You confirm that you are at least 18 years of age and have the legal capacity to enter into binding obligations.

Use of the Site, completion of an enquiry form, or correspondence with Nexgen does not create a client relationship. A client relationship is established only upon execution of a written engagement letter signed by Nexgen and the client.

All content on the Site — including text, graphics, logos, imagery, typography, design, and structure — is owned by or licensed to Nexgen and is protected by applicable intellectual property laws. No content may be copied, reproduced, republished, distributed or otherwise exploited without our prior written consent, save for personal, non-commercial review.

You agree not to:

• Use the Site for any unlawful, fraudulent or harmful purpose;
• Attempt to gain unauthorised access to any portion of the Site, including the Client Portal;
• Upload or transmit any malicious code, virus or harmful component;
• Use automated means (including scraping or harvesting) to extract data from the Site;
• Misrepresent your identity, affiliation or intent.

The Client Portal is reserved exclusively for retained clients of Nexgen. Access credentials are confidential, non-transferable and issued at our sole discretion. You are responsible for safeguarding your credentials and for any activity conducted under your account.

The Site may reference, and Nexgen may introduce clients to, third-party service providers. Nexgen does not control and is not responsible for the content, services, conduct or output of such third parties. Engagement of any third-party provider is at the client’s sole discretion and risk.

The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory. Nexgen does not warrant that the Site will be uninterrupted, error-free or free from harmful components.

To the maximum extent permitted by applicable law, Nexgen shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenues, data or goodwill, arising out of or in connection with your access to or use of the Site.

You agree to indemnify and hold harmless Nexgen, its principal, employees and affiliates against any claims, damages, losses or expenses arising from your breach of these Terms or your misuse of the Site.

These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai. Any dispute arising in connection with the Site shall be subject to the exclusive jurisdiction of the courts of Dubai, without prejudice to any mandatory consumer protection laws applicable in your jurisdiction.

We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
